The assignment contract is a written employment contract concluded between you and Morgan Philips Intérim, your employer.

The company in which you work is the User Company.

You are entitled to the same working conditions as the permanent employees of the User Company.

Your contract can be concluded for one of the following reasons:

PAID LEAVE (Congés payés)

At the end of your assignment, we will provide you with a compensatory leave indemnity corresponding to 10% of your gross remuneration (including the end-of-assignment indemnity).

Therefore, any day of leave taken during your assignment, with approval from your hierarchical supervisor, will be an unpaid leave day.

You must inform Morgan Philips Intérim by email before taking your leaves.

LEAVES FOR FAMILY EVENTS

These leaves are taken upon justification and without any seniority condition, at the time certain family events occur during your assignment:

• Birth or adoption of a child: 3 days
• Marriage or Civil Partnership (Pacs): 4 days
• Marriage of a child: 1 day
• Death of spouse, parent, stepparent, brother, or sister: 3 days
• Death of a child: 5 days
• Occurrence of a child's disability: 2 days

If the user company's collective agreement provides for longer leaves, you can benefit from them, subject to fulfilling the conditions set by that agreement.

SICK LEAVES

• You must send us your medical certificate within a maximum of 48 hours.
• If you are absent for more than 3 days, we will establish a salary certificate and send it to your social security center, which will start compensating you from the 4th day of absence.
• If you are absent for more than 4 days, you may be eligible for additional compensation from the 5th day of absence. We will handle the compensation process with AG2R La Mondiale on your behalf.

SALARY PAYMENTS ARE MADE ON THE 11TH
OF THE FOLLOWING MONTH AFTER THE WORK PERIOD

You have the option to request a weekly advance payment of 70% of the hours worked by indicating YES in the designated area on your validated attendance record (signature + company stamp). Upon request, advance payments are made every Monday at 2 PM. At the end of the contract, you will receive an end-of-assignment indemnity and compensatory leave indemnity.

END-OF-ASSIGNMENT INDEMNITY

To compensate for the precarious nature of your temporary worker status, you will receive an indemnity at the end of your contract, corresponding to 10% of your total gross remuneration earned during your assignment. However, this indemnity is not due in the following cases:

• If you are offered a permanent contract (CDI) within the user company
• If you resign
• In case of contract termination for serious misconduct
• If you refuse to implement the flexibility provided for in the contract

REIMBURSEMENT OF TRANSPORTATION EXPENSES

If you use public transportation to travel to your assignment location, transportation expenses will be reimbursed at 50% of your subscription cost (weekly, monthly, or annual), prorated based on the number of days worked during your assignment.

The reimbursement will be made upon presentation of a supporting document that you will transmit by email to the following address: contrat@fyte.com.

Your contract can be terminated either at its scheduled end date or prematurely under the following circumstances:

DURING THE TRIAL PERIOD WITHOUT NOTICE

The duration depends on your assignment dates:

• Assignment of less than 1 month: 2 working days
• Assignment between 1 and 2 months: 3 days
• Assignment of more than 2 months: 5 working days

DURING THE FLEXIBILITY PERIOD AT THE INITIATIVE
OF THE USER COMPANY:

The flexibility period is specified in your contract during which the user company can decide to advance or postpone the end date of your contract. It is calculated based on the total duration of your contract, including extensions, at a rate of 1 day for every 5 working days. The negative flexibility cannot reduce the contract by more than 10 days.

IF YOU HAVE FOUND A PERMANENT CONTRACT (CDI):

You must send us your resignation letter by mail along with a copy of your CDI or your job offer letter to justify the termination of the contract initiated by you. You must observe a notice period of 1 day per week, up to a maximum of 2 weeks.

IF YOU HAVE COMMITTED SERIOUS MISCONDUCT OR IN CASES
OF FORCE MAJEURE:

Only these two reasons can allow the user company to request the termination of your assignment before its end.

In addition to the benefits of the Social Security system, a number of national agreements have been reached between employee unions and the employer organisation of the sector, allowing you to receive additional compensation in case of illness or accident.

SOCIAL SECURITY:

Our temporary workers are affiliated with the general scheme of the Social Security system. As a result, you are entitled to the same benefits as any employee provided by the Social Security and Family Allowances.

MATERNITY OR ADOPTION LEAVE:

An additional allowance, in addition to the Social Security benefit, is paid during your maternity leave provided you have worked 590 hours in the last 12 months or 1,400 hours in the last 24 months in the profession.

HOSPITALIZATION:

If you are hospitalized due to illness or an occupational accident, you may be eligible for a fixed allowance for childcare, subject to meeting the conditions for compensation by AG2R RÉUNICA Prévoyance.

COMPLEMENTARY RETIREMENT:

We are affiliated with the AG2R La Mondiale supplementary retirement fund. Each year, this fund will send you a breakdown of your points from the previous year.

ILLNESS OR OCCUPATIONAL ACCIDENT:

In addition to the Social Security indemnity, subject to certain conditions, you may receive a supplement from Intérimaires Prévoyance in case of sick leave (from the 5th day) or occupational accident (from the 1st day).

DISABILITY AND DEATH:

In case of classification in the 2nd or 3rd category of disability, a quarterly annuity is paid if you have worked 1,800 hours in the profession during the 24 months preceding the work stoppage.

In case of death during the mission but unrelated to professional activity, a death benefit is paid to beneficiaries without any seniority condition.

Children are entitled to an education annuity provided the victim had 1,800 hours of seniority in the profession in the 24 months preceding the death.

In case of death resulting from a work accident or occupational disease, the beneficiaries of the victim are entitled to a death benefit, and if applicable, an education annuity is paid to the children if the death occurred during the mission or within a year following the date of the accident.

If death occurs as a result of a commute accident, a death benefit is paid to the beneficiaries. Children are entitled to an education annuity provided the victim had 1,800 hours of seniority in the profession in the 24 months preceding the death.
